Terms of Service

1. About These Terms
These Terms of Service ("Terms") are a binding agreement between you and WeKids Labs LLC, a Virginia limited liability company ("WeKids", "we", "us", or "our"), governing your access to and use of the WeKids and WeParents websites, applications, and services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Who Can Use WeKids
You must be at least 18 years old and the parent or legal guardian of any child whose profile you create. The Service is designed to be set up and controlled by an adult. By using the Service, you represent that you have the authority to enter into these Terms and to provide consent for any child profile you create.
3. Your Account
You are responsible for your account and for keeping your sign-in method secure. We offer password-free sign-in via passkeys, Google, or Apple, as well as one-time email codes. Keep your contact email accurate, and notify us promptly of any unauthorized use. You are responsible for activity under your account. One account is permitted per email address.
4. What WeKids Is
WeKids is a parent-controlled platform for children’s developmental content. Parents browse a curated catalog of safe content (videos, interactive activities, articles, and offline activities) organized around developmental skills, build each child a calm daily plan, and review what their children engage with. WeKids does not run an engagement-maximizing algorithm on a child’s experience and does not show third-party advertising to children.
5. Child Profiles and Parental Responsibility
You create and control all child profiles, and you decide what content each child can access. You are responsible for supervising your child’s use of the Service, for the information you choose to add to a profile, and for ensuring your use complies with applicable law. You may review or edit a child profile at any time from your account, and may delete a child profile and its associated data in-app from your account, or by emailing support@wekids.io — either is actioned within 48 hours.
6. AI-Generated Content
The Service lets you generate custom interactive activities and short videos using artificial intelligence. To do this, the text prompts you provide (and any content you ask to refine) are sent to our AI providers — Anthropic (Claude) for interactive activities and Google (Vertex AI / Veo) for video — which generate the output. You are responsible for the prompts you submit and for reviewing any generated content before sharing it with a child. AI output may be inaccurate or unexpected; we do not warrant its quality, accuracy, or suitability. Generated content is subject to the same content rules as all other content, and we apply technical safety controls such as sandboxing of interactive content. You remain responsible for ensuring generated content is appropriate for your child.
7. Content You Provide
You may upload videos and create or save content. You keep ownership of content you create or upload, and you grant WeKids a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content solely to operate and provide the Service to you and your family. You represent that you have all rights necessary to provide your content and that it does not infringe anyone’s rights or violate any law. All content must be appropriate for children. We may remove content that violates these Terms.
8. Acceptable Use
You agree not to: upload or share content that is illegal, harmful, infringing, or inappropriate for children; misuse, disrupt, or attempt to gain unauthorized access to the Service or its security; scrape, crawl, reverse-engineer, or copy the Service except as permitted by law; use the Service to harm or exploit any person, including children; or impersonate any person or entity. We may suspend access for conduct that violates these rules.
9. Subscriptions and Payments
WeKids offers a free tier and a paid subscription ("WeKids Plus") with additional features and usage limits. Paid subscriptions are billed in advance through our third-party payment processor on a recurring basis until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable. We may change prices or plan features with reasonable notice.
10. Offline Activities and Third-Party Content
The Service may surface information about offline activities, classes, camps, or workshops, some sourced from third parties. We do not operate these activities and are not responsible for them; your interactions with any third party are between you and that third party. We provide this information for convenience and do not endorse or guarantee any provider.
11. Our Intellectual Property
The Service — including its software, design, brand, logos, and original content — is owned by WeKids Labs LLC and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your family’s personal, non-commercial use, subject to these Terms.
12. Service Availability and Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. WeKids is a supplement to — not a substitute for — your own judgment and supervision as a parent. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that developmental content will produce any particular outcome.
13. Limitation of Liability
To the fullest extent permitted by law, WeKids Labs LLC and its members, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless WeKids Labs LLC from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
15. Termination
You may stop using the Service at any time. To delete your account, use “Close your account” in the app from your account (or email support@wekids.io); we remove your and your children’s associated personal data from active systems within 48 hours, as described in our Privacy Policy. Closing your account in-app begins a 48-hour grace period during which signing back in cancels the deletion. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Provisions that by their nature should survive termination — such as ownership, disclaimers, limitation of liability, and indemnification — will survive.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by email or an in-app notice. Your continued use of the Service after the changes take effect means you accept the updated Terms.
17. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Before filing any formal claim, you agree to first contact us to try to resolve the matter informally. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Virginia, unless applicable law requires otherwise.
